Defendants Oppose Motion to Bifurcate Issue of Punitive Damages in Upcoming Pinnacle Hip Implant Trial

DALLAS –– Defendants involved in the upcoming DePuy Pinnacle Hip Implant trial have opposed recent plaintiff efforts to bifurcate the issue of the amount of punitive damages, saying that the plaintiffs “have failed to identify a single concrete reason why bifurcation is appropriate in these cases.”
In the Aug. 27 opposition brief filed in the U.S. District Court for the Northern District, the defendants said bifurcation of the issue of punitive damages –– should jurors decide they’re warranted –– would be inappropriate and potential prejudicial.
