Pennsylvania Pelvic Mesh Mass Tort Judge Dismisses Sole Non-Diverse Defendant Secant Medical

PHILADELPHIA — The only in-state defendant in the Pennsylvania pelvic mesh mass tort has been dismissed after the presiding judge found the Biomedical Access Assurance Act (BAAA) shields it from liability.
On Aug. 25, Judge Arnold L. New of the Philadelphia Common Pleas Court found that Secant Medical Inc. is a biomaterials supplier as defined by the act and is not a manufacturer of the mesh implant at issue in the litigation.
Secant, based in Perkasie, Pa., was the only non-diverse defendant in the Pennsylvania MDL, therefore the case could now be removed to federal court.
