Howmedica, Stryker Corp. Say Common Benefit Order Will Cause ‘Irreparable Harm’

ST. LOUIS –– Howmedica Osteonics Corp. and Stryker Corp., have filed an opposition brief in support of efforts to appeal a Common Benefit Order issued in the Stryker Hip Implant MDL, maintaining its position that the order wrongfully requires the defendants to disclose plaintiffs’ counsel of all confidential settlements.
The Aug. 14 brief, filed in the 8th Circuit U.S. Court of Appeals, opposed a recent motion in which the plaintiffs asked that the appeal be dismissed on the ground that the Common Benefit Order is not appealable.
