ST. LOUIS — A district court did not err in dismissing a Prempro case for an attorney’s failure to register for the multidistrict litigation’s Case Management/Electronic Case Files system because the attorney had adequate warning that failure to do so could result in dismissal of his case, a federal appeals court has ruled.
On Aug. 13, the 8th Circuit U.S. Court of Appeals ruled that the lower court did not abuse its discretion because MDL judges “must be given greater discretion to create and enforce deadlines in order to administrate the litigation effectively.”
