CLEVELAND — An Ohio federal judge has allowed a plaintiff to amend his complaint against Globus Medical Inc. in a rod and screw case to allege with particularity the specific causes of action he is asserting against the manufacturer under the Ohio Product Liability Act.
In the July 31 order, Judge Christopher A. Boyko of the U.S. District Court for the Northern District of Ohio dismissed, however, the plaintiff’s claims of negligence, breach of warranty and punitive damages, finding they are subsumed by OPLA.
