JPML Refuses to Vacate Transfer Order of Pinnacle Suit Alleging Femoral Stem Fracture

WASHINGTON, D.C. –– The Judicial Panel on Multidistrict Litigation has refused to exclude a Pinnacle Hip Implant suit involving allegations of femoral stem fracture –– as opposed to loose metal debris –– from the national Multidistrict Litigation docket, opining that the discovery sought in the case will overlap with that conducted in the MDL proceedings.

In the Aug. 12 order, the JPML also declined to vacate a conditional transfer order of another Pinnacle Hip case, saying that challenges to federal jurisdiction can be addressed by the transferee judge.
