LOS ANGELES — A federal judge in California has refused to dismiss fraud claims against Wright Medical Technology Inc. for representations it made about the durability of an allegedly defective neck component in its PROFEMUR Total Hip System.
In a July 23 order, Judge Christina A. Snyder of the U.S. District Court for the Central District of California said that allegations the company failed to disclose reports of neck fractures in PROFEMUR hip implants, while touting a near-perfect safety record for the component, were sufficient for the fraud claims to proceed.
