LOS ANGELES — A North Carolina man allegedly injured by his DePuy Pinnacle Hip implant has asserted viable negligent failure-to-warn claims against a doctor who played a role in designing and marketing the device, a federal judge has ruled in remanding the case to California state court.
Judge Percy Anderson of the U.S. District Court for the Central District of California ruled July 29 that plaintiff James Turner’s decision to name Dr. Thomas P. Schmalzried as a defendant in the case did not run afoul of state laws limiting liability for injuries caused by medical devices to sellers and manufacturers …
