Wis. Court Dismisses Hip Implant Suit Against Zimmer, Says Plaintiff Failed to Recite Basis for Federal Jurisdiction

MILWAUKEE –– A Wisconsin federal court has dismissed a recently filed hip implant suit, finding that it did not have jurisdiction over the pleading, which did not state a basis for federal jurisdiction.

In its Aug. 8 opinion, the U.S. District Court for the Eastern District of Wisconsin said that the complaint had not recited a basis for federal jurisdiction, a rarity in complaints filed by counsel.

“The Court rarely, if every, sees a non-pro se complaint that fails to explain, in basic terms, why it was filed in federal court,” the order stated.
