ST. LOUIS — A federal appeals court has affirmed dismissal of a qui tam action accusing Stryker Corp. and I-Flow Corp. of marketing their pain pumps for intra-articular use, finding the alleged fraudulent acts alleged by the relator have already been publicly disclosed.
On Aug. 7, the 8th Circuit U.S. Court of Appeals concluded that the doctor who filed the action is not an “original source” of the information as required by the False Claims Act.
