ST. LOUIS –– Plaintiffs in the Stryker Rejuvenate and ABGII Hip Implant MDL proceedings have asked the U.S. Court of Appeals for the 8th Circuit to dismiss a recent notice of appeal filed by Howmedica Osteonics Corp., arguing that the order that the defendant seeks to contest is not appealable.
In the Aug. 4 brief, the plaintiffs additionally argued that the defendant has mischaracterized the Common Benefit Order at the heart of the dispute and has not met the requirements for a collateral order doctrine appeal.
