TRENTON, N.J. — A New Jersey appeals court has reversed a $2.1 million verdict rendered in favor of a woman who claimed the acne drug Accutane caused her gastrointestinal disease, finding her claims are barred by the learned intermediary doctrine and the state’s statute of limitations.
On Aug. 4, the Appellate Division of the New Jersey Superior Court also upheld two defense verdicts in the consolidated appeal, affirming the jury’s finding that the plaintiffs failed to prove that Hoffman La Roche’s allegedly inadequate warnings caused them to develop gastrointestinal disease.
