SACRAMENTO, Calif. — A California federal judge has adopted a magistrate judge’s recommendation to remand a transvaginal mesh case to state court rather than staying the case pending possible transfer to a multidistrict litigation, explaining that jurisdictional issues must be addressed before a stay is considered.
However, in the July 30 order, Judge Lawrence J. O'Neill of the U.S. District Court for the Eastern District of California found the defendant had an objectively reasonable basis for removing the case to federal court, therefore an award of attorneys’ fees to the plaintiff is not warranted.
