Zimmer Backs Motion for Emergency Hearing in NexGen Knee Implant MDL; Plaintiffs’ Counsel Says Crisis is ‘Contrived’

CHICAGO –– In support of its motion for an emergency hearing regarding the status of bellwether cases in the NexGen Knee Implant Products Liability Multidistrict Litigation docket, Zimmer Inc. argues that the only reason it requested the hearing on an exigent basis was so it would not be compelled to produce case specific expert reports in dismissed cases.
In a July 24 letter to MDL Judge Rebecca Pallmeyer, however, plaintiffs’ counsel warned the U.S. District Court for the Northern District of Illinois that Zimmer’s request is just the latest in its attempts to “derail the trial selection process.”
