CHARLESTON, W. Va. — A lawsuit filed against Boston Scientific Corp. in connection with its Obtryx transvaginal mesh device is time-barred under Massachusetts’ three-year statute of limitations because the plaintiff was aware of the cause of her injuries as early as June 1, 2009, a federal judge has ruled.
On July 11, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia found the plaintiff was on notice that the device had caused her alleged injuries three weeks after implantation.
