CHICAGO –– Zimmer has filed a motion to compel the production of an allegedly defective knee implant, saying that, under the rules of discovery, it has the right to inspect and test the device out of the presence of plaintiffs’ counsel.
In the July 10 motion, the defendant in the NexGen Knee Implant Multidistrict Litigation proceedings said that counsel for the plaintiffs erroneously asserts that it has the right to maintain a presence at any defense-conducted inspection, testing and analysis of the knee implant.
