Zimmer Moves for Summary Judgment in NexGen Knee Implant MDL, Says Claims Wrongfully Asserted Against Zimmer Entities

CHICAGO –– Zimmer Holdings and Zimmer Orthopaedic Surgical Products have moved for summary judgment in six bellwether cases pending in the NexGen Knee Implant Products Liability Litigation MDL, arguing that the plaintiffs have wrongfully asserted claims against them.
In the July 1 motion filed in the U.S. District Court for the Northern District of Illinois, the Zimmer defendants contend that they had “no role in the design, manufacture, sale, promotion, or distribution of the NexGen Flex and MIS 5950 tibial components.”
As such, the defendants maintained, they cannot be held liable as a matter of law.
