La. Judge Dismisses Case Against Zimmer for Plaintiff’s Failure to ID Defect in NexGen Components

NEW ORLEANS — A NexGen knee implant suit that defendant Zimmer Inc. said was never substantiated by any evidence that the plaintiff was injured by the device has been dismissed by a federal judge in New Orleans.
In a recent decision awarding summary judgment to Zimmer, Judge Kurt D. Englehardt of the U.S. District Court for the Eastern District of Louisiana said he found merit in the manufacturer’s contention that absent evidence of injury caused by components of the knee system, the plaintiff cannot maintain a successful product liability action under Louisiana law.
