Mo. Federal Judge Retains Jurisdiction Over Claims Against Biomet in Shoulder System Action

ST. LOUIS — A Missouri federal judge has severed claims against Biomet Inc. in connection with its shoulder system from claims against nondiverse healthcare providers and remanded the malpractice claims to state court, finding the nondiverse defendants were egregiously misjoined.

On July 8, Judge Audrey G. Fleissig of the U.S. District Court for the Eastern District of Missouri found the malpractice claims are not sufficiently related to the product liability claims to warrant remand of the entire case.
