La. Federal Judge Imposes Sanctions Against Takeda for Bad Faith Destruction of Actos Evidence

LAFAYETTE, La. — Takeda Pharmaceuticals Inc. acted in bad faith by destroying files that addressed the risk of bladder cancer allegedly posed by Actos, a Louisiana federal judge has ruled after reviewing the spoliation evidence presented at a recent trial.
In a June 23 order, Judge Rebecca F. Doherty of the U.S. District Court for the Western District of Louisiana imposed sanctions against Takeda after concluding that the drug maker’s corporate conduct “was not innocent, inadvertent, or merely negligent in its destruction, deletion, and attempt to conceal relevant information and evidence.”
