LAFAYETTE, La. — A Louisiana federal judge has denied plaintiffs’ motion to impose sanctions on Eli Lilly & Co. in an Actos bladder cancer case based on perjury allegedly committed by former Lilly employee Ronald Hoven, finding the evidence does not support the sanctions sought.
On June 11, Judge Rebecca F. Doherty of the U.S. District Court for the Western District of Louisiana further held that she does not have the authority to find that Hoven committed perjury because it is a criminal act that should be tried by a jury.
