Lexapro Suicide Case to Proceed Against Forest Laboratories, Miss. Federal Judge Rules

JACKSON, Miss. — A Mississippi federal judge has dismissed negligence claims brought against Forest Laboratories Inc. in a Lexapro suicide case to the extent they are asserted as independent tort claims outside the scope of the Mississippi Product Liability Act.
However, the plaintiff may pursue the claims as product liability claims subject to the MPLA's requirements, Judge Keith Starrett of the U.S. District Court for the Southern District of Mississippi ruled in the June 6 order.
The judge also denied as premature Forest’s motion to dismiss the case on the basis that the plaintiff failed to disclose her bankruptcy.
