Ind. Appellate Court Reverses Trial Court’s Order Denying Motion to Dismiss ASR Hip Implant Case on Forum Grounds

INDIANAPOLIS –– An Indiana appellate court has reversed a trial court’s decision to retain jurisdiction over a DePuy ASR XL hip implant case involving claims asserted by Virginia and Mississippi residents, opining that the forum-related order was erroneous.

In the May 30 order, the Indiana Court of Appeals held that the personal jurisdiction, convenience of the parties and choice of law issues in the hip implant case all favored dismissal.

The plaintiffs brought their claims in the Marion County Superior Court, contending that they suffered personal injuries as a result of DePuy Orthopaedics’ ASR XL Cetabular System prosthetic hip implant. …
