LOS ANGELES — A California federal judge has dismissed manufacturing and design defect claims asserted in a second amended complaint against C.R. Bard Inc. in connection with its PerFix mesh plugs, finding the plaintiff failed to support his claims with factual allegations.
On May 22, Judge Otis D. Wright II of the U.S. District Court for the Central District of California denied the plaintiff’s request to amend his complaint a third time, explaining that he was “manifestly aware” of the pleading deficiencies the first time his complaint was dismissed, yet failed to cure the deficiencies.
