Avandia MDL Judge Grants GSK Summary Judgment in 115 Actions, Finds Claims are Time-Barred

PHILADELPHIA — The judge overseeing the Avandia multidistrict litigation has granted GlaxoSmithKline’s motion for summary judgment in 115 cases, finding they are time-barred under the law of the plaintiffs’ respective states.

However, in the May 16 order, Judge Cynthia M. Rufe of the U.S. District Court for the Eastern District of Pennsylvania denied GSK summary judgment in two additional cases, finding a question of fact as to whether those plaintiffs’ claims are time-barred.
