NEW YORK — A New York federal judge has denied Novartis Pharmaceuticals Corp. summary judgment in an Aredia/Zometa injury case, ruling that the plaintiff has raised genuine issues of material fact as to whether the drug maker knew about the risks posed by the drugs and whether it adequately warned of those risks.
In the May 9 order, Judge Joseph F. Bianco of the U.S. District Court for the Eastern District of New York also denied Novartis’ motion to exclude the testimony of plaintiff’s expert witness Dr. Richard Kraut, finding he is qualified to offer opinions concerning causation (whether general …
