JPML Denies USPlabs’ Request for Consolidation of Jac3d, OxyElite Actions

WASHINGTON, D.C. — The Judicial Panel on Multidistrict Litigation has denied USPlabs’s request to consolidate for pretrial purposes nine actions involving its Jac3d and OxyElite Pro supplements, ruling that centralization is not necessary for just and efficient resolution of the litigation.
In an April 2 order, the panel explained that “different formulations of the products will not give rise to substantially overlapping discovery.”
Plaintiffs alleging injury caused by OxyElite and Jac3d have filed suit in federal courts in the Eastern District of Pennsylvania, Western District of Texas, Hawaii, California and Florida. According to those complaints, the supplements contain 1,3-dimethylamylamine …
