Ethicon Hernia Mesh Case is Time-Barred, Idaho Federal Judge Rules

BOISE, Idaho — An Idaho federal judge has dismissed an Ethicon Inc. hernia mesh case, finding it is time-barred because it was not filed within one year of the date that the plaintiff should have known the mesh was defective and caused her injuries.
On April 29, Chief Judge Winmill of the U.S. District Court for the District of Idaho held that the limitations period was triggered when the plaintiff’s mesh was surgically removed, rather than a few months later when her surgeon informed her during a follow-up visit that the mesh was defective.
