Missouri Court Allows Strict Liability Design Defect Claim to Proceed in Hip Implant Suit

ST. LOUIS –– A Missouri federal court has declined efforts by Wright Medical Technology Inc. and Wright Medical Group Inc. to dismiss a strict liability design defect claim in a hip implant suit, finding that the defense efforts were “premature.”
In the April 28 memorandum and order, the U.S. District Court for the Eastern District of Missouri delayed ruling on similar defense efforts to throw out the fraudulent concealment claim, allowing the plaintiffs 30 days to amend the cause of action.
