SALT LAKE CITY — A Utah federal judge has dismissed an action in which a woman claims she was injured by a vaginal mesh sling known as the Desara Sling, finding her claims are barred by Utah’s two-year statute of limitations because she was aware of the alleged cause of her injuries in November 2007.
However, in an April 28 order, Judge Ted Stewart of the U.S. District Court for the District of Utah denied defendant American Medical System Inc.’s motion for sanctions, finding the plaintiff’s claims had evidentiary support.
