PHILADELPHIA — A Pennsylvania federal judge has dismissed claims brought against technology firm Inmar Inc. and its subsidiaries in an Infants' Tylenol wrongful death action, finding the plaintiffs failed to link Inmar’s actions to the death of the plaintiffs’ son.
On April 25, Senior Judge Robert F. Kelly Sr. of the U.S. District Court for the Eastern District of Pennsylvania found the complaint does not allege facts to support a conclusion that the Inmar defendants carried out a “phantom recall” of Infants' Tylenol and/or conducted a “market assessment” that caused the infant's death.
