TRENTON, N.J. — A New Jersey appellate court has admonished counsel in a Fosamax case for failing to timely notify the court that the matter had been settled, saying the attorneys showed “not only a lack of consideration but a lack of concern for the wasted time and expense thereby incurred.”
On April 23, the New Jersey Superior Court, Appellate Division, explained that counsel did not advise the court of the January settlement until April, right before the court was set to issue its opinion in the matter.
