Louisiana Healthcare Providers Dismissed from DePuy ASR Hip Lawsuits

TOLEDO, Ohio — The DePuy Orthopaedics ASR Hip Implant MDL judge has dismissed medical malpractice claims from more than one half-dozen lawsuits after the plaintiffs failed to comply with a Louisiana statute that requires claims against healthcare providers to first be submitted to a state medical review panel.
In separate decisions issued April 13, Judge David A. Katz of the U.S. District Court for the Northern District of Ohio dismissed the claims without prejudice, despite allegations that the healthcare providers were both sellers and installers of the hip implant devices in question.
