HARRISBURG, Pa. — A Pennsylvania federal judge has quashed a subpoena seeking documents from a nonparty physician in a C.R. Bard vena cava filter case, ruling that the plaintiff’s “sweeping requests” would impose undue burden on the doctor and would require him to disclose his expert opinion without being compensated.
In the April 7 order, Judge William W. Caldwell of the U.S. District Court for the Middle District of Pennsylvania also awarded the doctor attorneys’ fees arising from his efforts to quash the subpoena.
