WASHINGTON, D.C. — A plaintiff in a New York Biomet M2a hip implant lawsuit has filed her opposition to the creation of a coordinated proceeding, saying the small number of existing cases can be easily handled by their original courts. Faber v. Biomet Orthopedic, LLC, No. 1:12-cv-00783 (E.D. N.Y.).
Nan Faber submitted her opposition to the Judicial Panel on Multidistrict Litigation July 19, say that plaintiffs moving for an MDL can’t meet their “heavy burden” of demonstrating how a coordinated proceeding is warranted.
