NEW ORLEANS — A Louisiana federal magistrate judge has granted the makers of generic Reglan summary judgment on claims that they illegally promoted the drug for off-label use, finding the plaintiffs failed to establish proximate cause because their doctor did not heed the warnings in prescribing the drug.
On March 27, Magistrate Judge Karen Wells Roby of the U.S. District Court for the Eastern District of Louisiana noted the doctor testified that his decision to prescribe metoclopramide to pregnant women for nausea and morning sickness was “based on his own experience.”
