OKLAHOMA CITY — A federal judge has dismissed without prejudice a lawsuit filed against device maker Corin USA by an Oklahoma man who claimed he developed metallic blood poisoning after he was implanted with the company’s Cormet Hip Resurfacing System.
U.S. District Judge Joe Heaton of the Western District of Oklahoma granted Corin’s motion to dismiss the case on March 14, after determining that the plaintiff failed to plead facts sufficient to support a parallel state law claim for negligence per se against the implant manufacturer.
