PHILADELPHIA — A Pennsylvania federal judge has denied a plaintiff’s motion to remand an Infant Tylenol wrongful death case, ruling that defendant McNeil PPC and the individual director and officer defendants were fraudulently joined.
On March 5, Judge Gene E.K. Pratter of the U.S. District Court for the Eastern District of Pennsylvania found McNeil’s principal place of business is in New Jersey, and the plaintiff failed to state a claim against the officers and directors of McNeil and defendant Johnson & Johnson.
