Zimmer, Plaintiffs Object to Each Other’s Bellwether Case Selections in NexGen Knee Implant MDL

CHICAGO –– Both sides involved in the NexGen Knee Implant MDL have objected to the other’s bellwether case selections, with Zimmer Inc. arguing that none of the proposed cases involve femoral component loosening, “the very issue upon which Plaintiffs have consistently attempted to justify this MDL.”
In its Feb. 28 brief filed in the U.S. District Court for the Northern District of Illinois, Zimmer Inc. contends that for three years, the plaintiffs have “complained that Zimmer Inc.’s NexGen Flex femoral components loosen at an unreasonably dangerous rate.”
