Mo. Federal Judge Remands Mirena Case, Says Bayer Failed to Establish Federal Jurisdiction

ST. LOUIS — A Missouri federal judge has remanded a Mirena injury suit, ruling that defendant Bayer Pharmaceuticals Inc. failed to establish federal jurisdiction by a preponderance of the evidence.
On Feb. 20, Judge Carol Jackson of the U.S. District Court for the Eastern District of Missouri explained that Bayer presented no evidence that the amount in controversy exceeds $75,000.
Several women and their spouses sued Bayer in the St. Louis Circuit Court, seeking damages for injuries allegedly caused by the intrauterine contraceptive system Mirena. They assert claims based on strict liability, failure to warn and negligence.
