Manufacturers’ Renewed Bid for Sanctions Denied in Ohio Surgical Mesh Case

COLUMBUS, Ohio — An Ohio federal judge has denied a renewed motion for sanctions filed by C.R. Bard Inc. and Davol Inc. in a surgical mesh case, finding the manufacturers cannot “unnecessarily” reopen this case to pursue their previous motion for sanctions.
On Feb. 18, Judge Gregory L. Frost of the U.S. District Court for the Southern District of Ohio held that the manufacturers were not entitled to an advisory opinion informing them of the deficiencies of their initial motion for sanctions and then an opportunity to cure those deficiencies.
