Ohio Federal Judge Retains Jurisdiction over Medtronic Infuse Case

CINCINNATI — An Ohio federal judge has refused to remand a case accusing Medtronic of violating federal and state law by promoting the off-label use of its Infuse bone-grafting device, ruling that the claims clearly implicate federal law.

On Feb. 13, Judge Timothy S. Black of the U.S. District Court for the Southern District of Ohio further ruled that this case involves “significant federal issues” because it concerns federal regulation of Class III medical devices such as Infuse.
