SHREVEPORT, La.-BASF Corporation, a subsidiary of Abbott Laboratories, the manufacturer of Meridia, responded to the claims of a class action complaint filed by an individual who allegedly suffered injuries as a result of using the weight loss drug. Bates, et al., v. Abbott Laboratories, et al., No. CV02-1973-S (W.D. La.).
The answer to the complaint, which was filed Oct. 4, contends that the plaintiff's suit fails to state a claim upon which relief can be granted because the manufacturer is protected under the Louisiana Products Liability Act (LPLA) and the doctrine of primary jurisdiction.
