TAMPA, Fla. — A case in which a man accuses Medtronic (NYSE:MDT) of failing to warn of the risks associated with the off-label use of its Infuse Bone Graft device has been remanded to state court by a Florida federal judge, who found the nondiverse healthcare defendants were not fraudulently joined.
On Feb. 9, Judge Richard A. Lazzara of the U.S. District Court for the Middle District of Florida found the plaintiffs have asserted viable causes of action against the healthcare providers.
