Ethicon May Introduce Complication Rates in Upcoming Mesh Trial, Federal Judge Rules

CHARLESTON, W. Va. — A West Virginia federal judge has addressed several motions in limine brought by the parties in an Ethicon pelvic mesh case that is scheduled for trial this month, ruling that the defense may introduce complication rates that are derived from reliable statistical methods and/or peer-reviewed literature.
On Feb. 5, Judge Joseph R. Goodwin of the U.S. District Court for the District of West Virginia also granted Ethicon’s motion to exclude evidence of other TVT lawsuits, finding such evidence is unduly prejudicial and would confuse or mislead the jury.
