Stryker Renews Bid to Dismiss Triathlon Knee Tort Claims on Statute of Limitations Grounds

BIRMINGHAM, Ala. – Stryker Corp. has renewed its motion for summary judgment on various tort claims in a Triathlon knee case, arguing that an Alabama plaintiff filed her suit outside the state's relevant statutes of limitations.

Stryker's Motion for Partial Summary Judgment was filed Feb. 4 in the U.S. District Court for the Middle District of Alabama, which denied a similar motion last year as it considered, and eventually denied, plaintiff's motion to remand (A story on that ruling was included in the Oct. 2013 issue of HarrisMartin's Hip & Knee Implant Litigation Report.).
