Federal Judge Denies Certification for Proposed Class of Kentucky Residents

LEXINGTON, Ky-For the second time this year, U.S. District Judge Danny C. Reeves denied certification to a proposed class of individuals who claim they allegedly suffered from injuries as a result on ingesting Oxycontin. Gevedon, et al., v. Purdue Pharma, L.P., et al., No. 02-08-DCR (E.D. Ky.).

Judge Reeves' Oct. 17 Memorandum and Order concluded that class could not be certified because the proposed class was not 'well-defined' and that the named plaintiffs did not qualify as members of the class. In addition, Judge Reeves found that the purported class did not fulfill the four prerequisites of Rule 23(a).
