DALLAS — A Texas federal judge has denied a plaintiff’s motion to reinstate her Prozac birth defect case against Eli Lilly & Co. (NYSE: LLY), finding she failed to show good cause as to why she failed to effect service on the drug maker in a timely manner.
On Jan. 16, Judge Sam A. Lindsay of the U.S. District Court for the Northern District of Texas noted that “mere inadvertence or mistake of counsel is generally insufficient to establish good cause.”
