Court Dismisses Stryker Cormet Hip Suit But Allows Plaintiff to Amend Warning and Warranty Claims

PHOENIX – A federal judge in Arizona has dismissed with prejudice a Cormet hip recipient's strict liability and design defect claims against Stryker Corp., but she said the plaintiff should have an opportunity to amend other claims that are not preempted by federal law.
Judge Cindy K. Jorgenson of the U.S. District Court for the District of Arizona ruled Jan. 17 in a products liability suit filed by Jeffrey Poll against various Stryker defendants and Howmedica Osteonics Corp.
