Boston Scientific Denied Summary Judgment in Pelvic Mesh Case

CHARLESTON, W. Va. — A West Virginia federal judge has denied Boston Scientific Corp. summary judgment in a pelvic mesh device case, finding an issue of fact as to whether the plaintiff could have discovered a connection between her injuries and the device within the two-year statute of limitations.
On Jan. 17, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia found that because the plaintiff’s surgeon never informed her of a possible connection between her injuries and the mesh, “one could reasonably conclude that her body simply ‘didn't like’ the mesh.”
